Gina Alajar poises to throw counterpunch

She’s getting ready to rumble.

Actress-director Gina Alajar is considering taking legal actions against those she alleged had “unauthorized usage” of her Facebook status message that seemingly linked her with the hotly discussed rumor involving boxer Manny Pacquiao and starlet Krista Ranillo.

“Nag-e-explore din ako ng legal options ko dahil nga sa unauthorized usage nila…[sa] unauthorized opening nila ng Facebook ko,” said Gina on ABS-CBN’s morning show, “Umagang Kay Ganda,” Nov. 26.

In a separate interview, Gina insisted that as a Facebook account owner, it is her prerogative to post her opinion in the social networking site.

“I can say anything and everything in my profile. Nobody can stop me,” she boldly declared on “TV Patrol,” Nov. 25.

According to Facebook’s Privacy Policy (last revised on Nov. 19, 2009), “information might be re-shared or copied by other users” in accordance with the social networking site’s “Statement of Rights and Responsibilities” (last revised Aug. 28, 2009) rules.

One of these rules states that “If you collect information from users, you will: obtain their consent, make it clear you (and not Facebook) are the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it.”
     
The site defines “information” as “facts and other information about you, including actions you take.”

Gina maintained that she is apathetic to the intrigues that seemingly made punching bags out of Manny and Krista. She affirmed that she is merely trying to clear her name.

“Wala akong isyu dun sa kung anuman ang nangyayari sa kanila…na pinag-uusapan sa lahat ng parte ng Pilipinas. Wala akong pakialam dun.

“Ang isyu ko lang dito---and I want to repeat this over and over again---ang isyu ko lang dito ay ‘yong…pagpa-publish ng aking Facebook profile nang walang permiso,” said she.

Facebook states that its users “will not post content or take any action on Facebook that infringes or violates someone else's rights or otherwise violates the law” or for “anything unlawful, misleading, malicious, or discriminatory.”

The social networking site defines “content” as “anything you post on Facebook that would not be included in the definition of ‘information.’”

Facebook’s Privacy Policy also states that users may customize their privacy settings to control other user’s access to their information and content.

Asked during the “Umagang Kay Ganda” interview what message she would give the Ranillos, Gina, who separated from actor Michael de Mesa allegedly because of Krista, said, “Gusto mong ma-censor tayo?”

On the other side of the ring, the Ranillos, through their lawyer, Tonisito Umali, are already exploring legal means as a seeming counterpunch against the director-actress' “defamatory” jabs.

“Pinag-aaralan kong mabuti ang pananagutan ni Ms. Gina Alajar,” Umali said. “Very, very defamatory. Very, very libelous.”

The Ranillo family has ordered their lawyer to “study the derogatory and untruthful comments made by Gina Alajar in her Facebook (and published in major newspapers and shown in major TV shows) and [similar comments made by] other media personalities to determine whether such comments are considered unprotected speech or libelous.”

Krista’s father, Mat, who is the signatory of the family’s official media statement dated Nov. 24, firmly denied the rumored illicit affair involving his daughter and Manny, who has been married for 10 years now.

“Our family categorically denies that any inappropriate relationship exists between Pacquiao and Krista Ranillo. We thought that our silence will stop all these lies being peddled in the Philippine media by some unscrupulous people. We were wrong,” his statement read.

While Mat has broken his silence about the controversy, a broadsheet entertainment editor enumerated other rumors that Mat did not address in his statement nor prior interviews, such as:

“(1) He [Mat] has been acting as Krista’s chaperon to affairs where Manny was also present, (2) He has been getting 'financial support' from Manny, and (3) He’s nurturing closeness to Manny who he can count on when he (Mat) runs for congressman in Mindanao.”

Umali said that the Ranillos choose to stay in the US for now in light of “death threats” they claim to have received over the Manny-Krista issue.
