Sacked NORECO 2 directors to file suit with CDA

DUMAGUETE CITY (PNA) — Two former members of the Negros Oriental 2 Electric Cooperative (NORECO 2) Board of Directors are filing an administrative complaint before the Cooperative Development Authority (CDA) in connection with what they claim as their “unfair and unceremonious removal” from the Board.

The case will be filed by Engineer Ricardo Maputi and retired Col. Constantino Sayson through their legal counsel, Atty. Joel Obar.

In a recent press briefing, Obar said the letter of the CDA, through CDA Executive Director, Wilfredo Santillan, required the Board of the electric cooperative to submit amendments to its by-laws to the CDA before the ouster could be considered effective.

But even before it was approved and adopted by the general assembly last March 28 in Zamboanguita, the NORECO 2 management already removed Maputi and Sayson from their  respective positions, Obar said.

Meanwhile, Noreco 2 Board Secretary Juper Aguilar said that deleting the two other districts in Dumaguete, which were represented by Maputi and Sayson, just came out of the blue when the electric cooperative was asking for a certification of tax exemption from the Bureau of Internal Revenue.

Before the certification could be issued, the BIR required the cooperative to submit a certification of good standing from CDA, which in turn asked NORECO 2 for a certificate of amendments of their cooperative by-laws.

In the course of complying with all the certifications, the CDA found the redistricting of Dumaguete into three districts illegal.

As a result, it ordered NORECO 2 to delete the redistricting provision.

Earlier, Sayson said he did not care if he was removed from the NORECO2 Board after the expiration of his term on March 31, 2010, provided all the three positions should also be removed after which, NORECO 2 calls for an election.

Sayson and Maputi consider themselves the “thorns” of management and are singled-out in the order because of their vigilance against certain alleged anomalies in the cooperative.
