CBCP official says reviving the death penalty will not solve crimes
MANILA, Philippines (PNA) — An official of the Episcopal Commission on Prison Pastoral Care (ECPPC) of the Catholic Bishops’ Conference of the Philippines (CBCP) said that reviving the death penalty would not solve crimes.
ECPPC Executive Secretary Rodolfo Diamante said that those who are pushing for the imposition of the death penalty anew just want an immediate solution to the crimes.
He said what the government should do is to look at the problem of enforcing the law.
“Instead of looking at death penalty, they have to think of the other stages of the criminal justice system which starts from building up the case, arresting the perpetrators of the crime and seeing to it that they’ll be properly persecuted. The last stage is the death penalty,” Diamante explained.
He warned that if these are not strengthened, there will always be people being able to run away with the crime that they have committed.
Diamante added that the government should study and come up with a very strong crime prevention program.
With this, he urged those who are pushing for the death penalty to think of ways on how to prevent crime.
The issue on reviving the capital punishment has emerged in the midst of the brutal deaths of individuals engaged in car buy and sell business.

Yes, the Death Penalty may not solve crimes, but they sure will deter them. Although flogging and waterboarding woud be ideal alternatives as a means to finally getting to the death Penalty.
Seriously, I understand their concern, but isn't there supposed to be a separation of church and state here in the Philippines?
The separation between the two only means that the people are free to choose a religion that they want to be in, it doesn't necessarily mean that the Church cannot react to the government's actions.

Having a death penalty is also part of the system no matter where you want to put it. Right now lawless elements are not intimidated by our justice system. The most heaviest penalty only is life imprisonment after that no more. Criminals dont mind this at all they could plan to escape prison if they want to it the caught. Having a death penalty gives them something to think about. I dont think that you could still rehabilitate a criminal who is so used into killing people, raping your child, selling drugs to minors. What ever you do they would still go back to what they are used to do that what's make them tick.
I agree. Reviving the death penalty will not solve crimes. The solution is by the create of a law that will enable private citizens to have a deciding voice or vote in justice to force corrupt and abusive powerful officials to follow or obey the rule of law.
The means to accomplish this is by the adoption of the Grand Jury System. This is a group of private citizens composed of 23 members that will be empowered to secretly investigate and indict grafters and crime offenders in court.
A Grand Jury is different from the Trial Jury that you may be thinking about. You may not know about the Grand Jury because it operates very secretly. The crime offender it will investigate will not even know that he is being investigated and indicted in court by the Grand Jury. He will not know that witnesses are being held for questioning by the grand jury about his crime.

The other jury to organize is the Trial Jury composed of 12 private citizens and it will operate under the guidance and instruction of a presiding judge. The judge will enforce court discipline and who will determine the admissibility of evidence or not. He has no authority to decide a case under trial. The trial jury shall be required to listen to instruction and testimony of each witness and see or examine the evidence presented. The trial jury shall exclusively decide the case.

By what provision in the constitution that will allow the creation of juries?
Article II, Section 1, of the constitution is the basis of creating the jury system wherein the sovereign power and authority is established over their officials and employees in the government. It shows that the people are the masters of society while public officials are the servants of the people.
How can we be sure that the people will be brave enough to decide to indict in court or to try and hear in court and decide against the wishes of powerful officials? I think the people will be afraid to do that.
The livelihood and jobs of private citizens with their private employers is beyond the power of any public official to control or to terminate them from their jobs in the private sector. With more reason, a private citizen who is jobless will have no fear to decide a case because he has no job to be taken away from him.
Jurors likewise shall be given protection by police authorities under the order of the judge.
For this reason, private citizens will not be afraid to decide when asked to do so by the judge but the judge has no power to dictate which way the jury shall decide.
The juries will be doing their jobs under the protection of the presiding judge for their safety.
A public official who will disobey the judgment of the Trial Jury will be liable for accusation or indictment of the crime of obstruction of justice by the Grand Jury.
Adoption of the Jury Systems shall level the playing field of justice between the common ordinary people and government high officials. Decisions of the juries will force public officials to obey the rule of law or else the people through the Grand Jury can fight back in justice by indicting said officials for obstruction of justice.
