As a result of 'ninja cops' probe, partylist solons move for an independent IAS for PNP

Partylist lawmakers Tuesday urged the House of Representatives leadership to look into the urgency of passing a bill that would create an independent internal affairs unit in the police service as a legislative proposal resulting from the “ninja cops” inquiry in the Senate.

Reps. Jericho Nograles (PBA Partylist) and Jorge Bustos (PATROL Partylist) noted that the strong need to dismantle the Internal Affairs Service in the Philippine National Police surfaced during the Senate probe that implicated PNP chief General Oscar Albayalde to the disappearance of a huge quantity of shabu supposedly seized during a police raid in Mexico, Pampanga.
Albayalde was forced to step down from his post several days before he was due to retire as a result of the testimonies of former fellow PNP officials who accused him of providing protection to policemen accused of stashing away over 100 kilos of shabu during the police operation.
Nograles filed House Bill 3065 seeking to amend Republic Act 8551 or the Philippine National Police Reform Reorganization Act of 1998 by creating an IAS that is outside the PNP chain of command.
Nograles noted that the current PNP-IAS may not act independently if it is tasked to investigate the highest official of the PNP like Albayalde.
“The IAS Inspector General reports directly to the Chief PNP and therefore not independent of the PNP,” he said.
A former police officer, Bustos backed the proposal to create an internal affairs unit that is beyond the reach of the PNP leadership.
“There should be independence. It would work both ways. The investigation would have integrity,” said Bustos.
The partylist solon aired the confidence that resolution of cases investigated by an independent IAS would be more acceptable to the public.
HB 3065 provides that the IAS be removed from the supervision and control of the PNP chief. Instead the unit will be placed under the direct supervision of the Secretary of the Interior and Local Government.
The bill also clothes the IAS the authority to make recommendations for the selection and promotion of PNP personnel.
The proposed IAS is also tasked to provide assistance to the Office of the Ombudsman and other PNP Disciplinary offices in cases that involve PNP personnel.
Nograles said it can also recommend the admission to the witness protection program of the Department of Justice of witnesses who are vital to the prosecution of PNP Personnel involved in criminal cases.
Nograles said the proposed IAS will have its own organizational hierarchy which will be headed by an Inspector General. It will establish regional, provincial, city and municipal offices nationwide, with a separate staffing pattern and mode of recruitment for its personnel.
