Days after the petition to allow former Senator Gregorio Honasan to file his candidacy was granted, his lawyers are now seeking the Makati Regional Trial Court’s approval to have Honasan subjected to a battery of medical examinations to determine the extent of his physical health and well-being.
Daniel Gutierrez, Honasan’s lead counsel, said they are set to file a petition asking Makati RTC Branch 148 Judge Oscar Pimentel to allow his client to undergo medical examinations to ascertain if his injuries sustained when he tried to elude arrest last November, are now healed.
"He needs to be seen by a doctor because it has been a long time since his foot was given attention. Honasan needs to be subjected to an X-ray to determine if his foot injuries have already healed," Gutierrez said.
According to Gutierrez, the judge has already approved his client’s request when the court conducted an inspection of his detention cell at Fort Sto. Domingo in Sta. Rosa, Laguna yesterday morning.
Though the judge has readily agreed to their request, Honasan’s lawyers were told to nevertheless file the necessary motion to formalize their petition.
"The judge was able to see his condition. He is still having difficulty walking even if he is aided by crutches. His left heel was crushed while his right one suffered deep lacerations. The injuries had not fully healed even if he no longer uses a cast," Gutierrez said.
He said it doesn’t matter where the court will have him examined as long as his client is subjected to a medical test.
"This is also to stop speculations and qualms once and for all that our client is not a flight risk as what government officials are trying to say," Gutierrez said.
The court is expected to issue an order at the end of the month to determine whether to approve Honasan’s appeal to be transferred from Fort Sto. Domingo to the Makati City Jail.
Honasan is staying at the one-storey bungalow building where former Moro National Liberation Front (MNLF) chief Nur Misuari was detained.
Aside from the coup charges for his alleged involvement in the failed Oakwood mutiny in 2003, Honasan is also facing rebellion charges before a Makati court in connection with the rightist-leftist plot to topple President Arroyo from power in February, 2006.
