The Sandiganbayan Special Division yesterday granted former President Joseph Estrada’s request to visit his ailing 101-year-old mother, but only on Sunday, Feb. 18, instead of the three-day visit he earlier requested.
In a two-page resolution signed by Special Division Presiding Justice Teresita Leonardo de Castro, and Associate Justices Diosdado Peralta, and Rodolfo Ponferrada, Estrada was allowed to see his mother Doña Mary Marcelo Ejercito from 7 a.m. to 7 p.m. on Feb. 18 at her house on Kennedy St., Greenhills, San Juan.
Estrada’s lead counsel Rene Saguisag filed a motion on Feb. 2 citing the detained leader’s intention to visit Doña Mary either on Feb. 9 to 11 or Feb. 16 to 18.
He was prompted to file the motion after the Special Division denied last Jan 29 his request to allow him to see his mother every weekend after information reached the detained leader that his mother’s condition is fast deteriorating.
The three-man Special Division said in its earlier resolution that the court could not give a blanket authority for Estrada to visit his mother on a weekly basis.
Instead, the court advised the defense panel to file the appropriate motion "as the need arises" and it must contain a specific date and time of the intended visit.
On Feb. 18, Estrada will be escorted by the Philippine National Police (PNP) from his resthouse in Tanay, Rizal where he is detained at 8 a.m. to his mother’s residence in Greenhills, San Juan.
The former President is allowed to stay until 5 p.m. of the same day and will be returned to his detention quarters in Tanay.
Likewise, the use of any means of communication and electronic devices during the visit will be under the strict authority of the PNP escort.
