Matinee idol Diether Ocampo, who celebrated his 33rd birthday on July 19, received a belated and most unusual ‘gift’ from the Social Security System: a complaint.

Filed on July 20 at the Quezon City Prosecutor's Office is a one-page complaint by Pepito Nocasa, account officer of the SSS San Francisco Del Monte branch.

Nocasa’s complaint alleged that the actor, an ABS-CBN talent, violated Republic Act (RA) 8282 or the Social Security Act of 1997, a law that necessitates the presentation of workers' records during routine assessments.

According to the complaint, Ocampo (real name, Diether Pascual) “failed to submit or present records of his workers” during a standard inspection conducted at his water refilling station, the Ichi Wateru, located in Barangay Bagong Pag-asa, on May 9, 2008.

The inspection was part of the SSS’s duties to verify employer records to determine which ones have delinquent accounts with the SSS.

During the inspection, Nocasa alleged that he asked Ocampo for documents of payrolls, salary vouchers, appointment papers, time sheets, and other records of his employees.

Ocampo failed to show these documents, said Nocasa.

Nocasa added that he sent a demand letter a few months later, again asking Ocampo for the said records but to no avail.

Violation of RA 8282 is punishable by fines ranging from P5,000 to P20,000, as well as imprisonment ranging from 6 to 12 years.
