Cavite City bet's win affirmed

CAVITE CITY -- The Commission on Elections (Comelec) en banc has dismissed a motion for reconsideration filed by Cavite City Vice Mayor Romeo Ramos, through his legal counsel Romulo Makalintal in connection with the election protest over the vice mayoral post here.

The commission disapproved the motion for lack of merit and upheld the decision of Comelec’s first division, which annulled the proclamation of Vice Ramos and proclaimed Dhino Carlo Chua as the duly elected vice mayor of Cavite City in May 2007 elections.

The 107-page resolution was signed by all members of the Comelec en banc -- Chairman Jose Melo, Commissioners Rene Sarmiento, Lucenito Tagle, Nicodemo Ferrer, Ellias Yusoph, and Armando Velasco.

The members of the Comelec en banc unanimously affirmed the March 20, 2009 decision which was assailed by Ramos and which declared the proclamation of Ramos null and void.

The Comelec en banc also ordered Ramos to cease and desist from performing the duties and functions of vice mayor of the city.

Earlier, the Comelec 1st division said it had discovered fake and spurious ballots that were filled up by one person.

This findings paved the way for Chua’s victory, giving him more than 600 votes over Ramos.

“Ang panalo po ni Vice Mayor Dino ay tagumpay din ng ating lungsod sapagkat si Vice Mayor ay ang mas may karapatang manilbihan sa bayan,’’ barangay captain Christopher Paredes said.
