The Department of Justice (DoJ) charged with murder on Monday six suspects in the mob-style murder of Ruby Rose Barrameda.

The DoJ found probable cause to charge Manuel Jimenez, Jr., who is Ruby Rose's father-in-law, and his brother Lope Jimenez for the murder of Ruby Rose whose body was fished out of the sea encased in a drum filled with cement.

The resolution finding probable cause to charge the suspects with murder, and recommending no bail for them, was filed by DoJ prosecutors before the Navotas regional trial court.

Four other suspects were also charged with murder, including Manuel Montero, who admitted his participation in the murder and tagged Manuel Jr. and Lope as masterminds.

Montero, however, would be recommended by DoJ prosecutors to be discharged from the list of the accused so he can affirm his testimony in court and turn state witness against the suspects in the murder.

Ruby Rose's husband, Manuel III, has not been charged because the DoJ did not find sufficient evidence to prove his participation in the murder.

DoJ Secretary Agnes Devanadera said based on Montero's confession, Manuel III did not overtly participate in the murder.

"No overt acts had been attributed to him so he was not included in the list of the accused," Devanadera said.

Devanadera said the motive for the killing is not as vital in determining probable cause to charge suspects as in court proceedings.

Montero's confession about the murder of Ruby Rose, which also led to the discovery of her body under the sea, was the basis of the DoJ resolution finding probable cause to charge the six suspects with murder. The DoJ also gave weight to the forensic findings of the police identifying the body fished out of the sea as indeed that of Ruby Rose.

The other accused are Eric Fernandez, Leonardo "Spike" Descalso, and Robert Ponce, who have all been implicated by Montero in his confession.
