Korean pop star Rain weathers court battles

A Seoul court has dismissed a lawsuit filed by Korean concert producer Wellmade Star M seeking nearly $4 million in damages against Korean pop star Rain (real name Jung Ji-hoon) and JYP Entertainment over canceled concerts in the US and China.
In a decision issued on Jan. 28, the Seoul Central District Court ruled that Rain and JYP Entertainment, the singer’s former agency, cannot be held liable for the cancellation of Rain’s World Tour concerts in the US and China in 2007, saying that the inadequate preparations of Star M’s local promoters and partners were to blame.
Star M filed the lawsuit in March last year against Rain and JYPE for "breach of contract."
In the complaint, Star M accused Rain and JYPE of failing to honor an agreement made in 2006 to complete the 35 “Rain’s Coming” World Tour concerts in China, US, Vietnam, Australia, Japan, and Korea.
In early 2007, Rain Corp., an American recording company, sued Rain, JYPE, and Star M for trademark infringement over the stage name “Rain.”
The case was dismissed by a Nevada District Court, ruling that the company would not suffer any damages if the singer used his name in his concert tour in the US.
An American Beatles tribute band called Rain also challenged the pop star over the name “Rain” that prevented him from performing in the US.
Rain’s 16 scheduled concerts in San Francisco, Hawaii, Los Angeles, Shanghai, and Toronto were canceled due to various reasons.
In the lawsuit, the concert producer said Rain and JYPE knew about the copyright problem in the US but they didn’t inform the company.
Star M said the copyright infringement issue, which prevented Rain from performing in the US, was the reason that the concerts were canceled.
This was refuted by Seoul courts.
It noted a clause in the concert contract stating that Rain and JYPE cannot be held liable for issues with third parties, thus Star M cannot hold them responsible for the cancellation.
In March last year, Rain and JYPE were ordered by a Honolulu court to pay about $8 million in damages to concert producer Click Entertainment for the cancellation of a concert in Hawaii. Three months after the decision was handed down, Rain and Click Entertainment settled the case regarding the compensation.
