Fans give Richard Gutierrez’s legal wins the thumbs up

Fans of Richard Gutierrez are ecstatic over the decision of the Department of Justice (DoJ) to dismiss the “reckless imprudence resulting in homicide” case filed by Lorayne Pardo against their idol.

“Grabe kanina napaiyak pa talaga sa nabasa ko, God is good nga naman,,,hapi hapi joy joy joy tayong mga chardees, ngayon ay makakapagconcentrate na talaga si Chard sa work nya dahil tapos na ang mga worries nya,” said one fan in a PinoyExchange forum.

Pardo, wife of Gutierrez’s personal assistant Nomart, who died in a car accident last year in Silang, Cavite, with Richard behind the wheel, filed the case last July 23 at the Office of the Provincial Prosecutor in Imus, Cavite.

Both parties filed a petition for review in reference to the Provincial Prosecutor of Cavite’s resolution that found “probable cause” in the alleged crime.

However, the DoJ resolution dated March 10, 2010, dismissed Pardo’s appeal.

Another Richard fan felt like she had won the lottery upon hearing the news.

“Sa sobrang happy ko feeling ko nanalo ako ng lotto, di ko maipaliwanag, lagi kong naiisip yun, diba dapat may hearing sa Mar. 30, kaya di ako makapaniwala, Now Chard can finally focus.”

According to the DoJ’s decision, the “Complainant's statements are, therefore, hearsay at best and clearly inadmissible in evidence pursuant to Section 13, Rule 130 of the Revised Rules of Evidence,” because she is “testifying on matters not of her own personal knowledge."

The resolution cited that the "complainant could not have known the road conditions, the manner by which the accident happened, the damages caused to the vehicle and its passengers, or respondent's actuations immediately after the accident because she simply was not present at the scene of the incident. None of the police officers who investigated the scene of the accident executed statements to identify said reports or to narrate their findings.”

In addition, the decision says there is “no merit in complainant's assertion" that the Prosecutor “completely [disregarded] the presence of the qualifying circumstance of the failure of respondent to lend immediate assistance to her husband…"

The DoJ also contended that they “cannot sustain the assailed resolution” because Pardo’s camp “failed to establish the last element of the crime, i.e., that there has been inexcusable lack of precaution on the part of the offender.”

According to the six-page resolution signed last year by Cavite prosecutor Emmanuel Velasco, Gutierrez was driving his Nissan Skyline GTR sports car “to mind-boggling speeds at the time of the accident.”

However, to say that the “mind-boggling speed” of the vehicle caused such grave damage is non-sequitur, the DOJ resolution added.

Still, a Chardee—what the fans call themselves—hopes for Richard to be more careful next time in order to avoid another accident.

“Oo wala ng sadness pure joy na lang sana maging mas maingat na si Chard ngayon at saka sana ang GMA wag na masyado maraming work na sabay sabay para kay Chard, bigyan naman nila ng break yung tao kahit isang araw lang para makapagrecharge siya,” she said.

“I know RG will take care of the Pardo kids, RG naman has been doing this even before this tragic accident happened, ngayon pa kaya. The only thing that RG wants to make sure eh yung benefits na ibibigay nya yung mismong mga bata ang makikinabang, RG has been helping the kids with their school na noon pa…” another one maintained.

This is Gutierrez’s second triumph after reaching an amicable settlement with the Philippine Entertainment Portal earlier in February, regarding the libel case he filed against the entertainment website for what he claims as an inaccurate article about an alleged altercation between him and Michael Flores in 2009.

One of Gutierrez’s fans may as well have been speaking for the rest in expressing how they feel about Richard’s legal wins: 

 “Thank God!!!!  Waaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaahhhhhhhhhh!!!!!!!!!!!!!!!!!!!!!!! Now, I can really go to sleep. Hahaha!!!”
