CA junks petition for ‘writs of amparo’
The Court of Appeals (CA) has junked the petition for the issuance of writs of amparo, habeas data and habeas corpus filed by the wife of detained Air Force Capt. Joenel Pogoy.
Pogoy is detained at the Philippine Air Force (PAF) custodial center in Villamor Air Base, Pasay City while facing court martial proceedings for criticizing President Arroyo and exposing the alleged corruption in the military in his videos posted on the popular video-sharing website YouTube.
He was charged with violations of Articles of War 96 and 97 or “conduct unbecoming of an officer” and “conduct prejudicial to good order and discipline.”
Pogoy’s wife, Maria Crisanta, had petitioned the Supreme Court to order President Arroyo and several PAF officials, led by their commanding chief Lt. Gen. Oscar Rabena, “to immediately desist from doing acts that would threaten or seem to threaten the life, liberty and security” of her husband.
She said she fears for the life of her husband after he was labeled as a rebel soldier and terrorist.
The High Court referred the case to the CA. (Edmer Panesa)
