Judge Balut to continue hearing murder case against Ivler
Judge Alexander Balut of the Quezon City Regional Trial Court Branch 76 will continue to hear the murder case against Jason Ivler after he denied the motion for reconsideration filed by the prosecution asking him to reverse his earlier decision to junk the motion to inhibit himself from the case.
Balut maintained that there is no need to inhibit himself from hearing the case, saying that he “conscientiously believes to have acted within the parameters of the constitution, the law, and the concepts of fair play and orderly administration of justice."
On June 8, the prosecution filed the motion for reconsideration of Balut’s earlier order junking the former’s motion for Balut to inhibit himself from the case claiming the judge “committed procedural lapses’’ in handling the case and has afforded the accused undue advantage.
Ivler is facing murder charges for allegedly killing Renato Victor Ebarle Jr. during a road altercation in Quezon City in November last year.
The road rage murder suspect was injured after he shot it out with arresting agents of the National Bureau of Investigation last January.
Following his surgery and confinement at Quirino Memorial Medical Center, Ivler was eventually brought to the Quezon City Jail, where he continues to be detained.
