Court junks anti-wiretap case vs TV host
The Pasay City Metropolitan Trial Court (MTC) Wednesday junked the Anti Wire Tapping case filed against television host, Cecilia “Cheche” Lazaro, for lack of evidence.
Based on the 28-page decision by Pasay MTC Judge Eliza Yu of Branch 47, the court found that Lazaro did not violate the Anti -Wire Tapping Law filed against her by Government Service Insurance System (GSIS) Vice President for Public Relations and Communications, Ella Valencerina.
Yu said the court favored the petition filed by Lazaro through her lawyer, Emmanuel Lombos that she did not violate the Anti-Wire Tapping Law for airing her conversation with Valencerina last November 10, 2008.
Court records showed that Lazaro called up Valencerina to get their opinion on the premium base policy of the GSIS of which about 500 teacher-members will be affected.
Lazaro had told Valencerina that the issue would be tackled in the discussion of Probe Team segment “Perwisyong Benepisyo.”
Valencerina, in her petition, claimed that Lazaro violated their agreement because during an interview through telephone, she asked the television host not to record their conversation regarding their discussion on the issue.
However, to the surprise of Valencerina, the conversation was recorded and aired during the regular programming of Probe Team, a television program produced by Lazaro.
After studying the case filed against Lazaro, Yu found out that the move of Lazaro in recording her conversation with Valencerina was not considered a violation of the Anti-Wire Tapping Law.
