Ivler Seeks Medical Confinement Anew
Manila, Philippines – With the case being handled by a new judge, murder suspect Jason Ivler entered his first plea for the resolution of his appeal to be confined in a hospital for another surgical procedure.
Ivler’s lawyers filed before the Quezon City Regional Trial Court Branch 219 under Judge Bayani Vargas an urgent motion to resolve his motion for medical confinement.
“The motion is ripe for resolution…Presently, the condition of the accused is deteriorating and he urgently needs to undergo appropriate medical treatment,” his lawyers stated.
The murder suspect wants to be confined in a hospital so that his doctors can operate on him to reverse his colostomy which allows him to defecate only through a bag.
The colostomy was caused by the injuries he sustained after he shot it out with pursuing National Bureau of Investigation (NBI) agents in his mother's Blue Ridge residence in Quezon City last January.
Ivler’s counsels said they repeatedly filed the motion before the QCRTC Branch 76 under Judge Alexander Balut first on May 18, then on May 26 and on June 11 before the judge decided to inhibit from the case which was eventually re-raffled.
The defense said the prosecution did not oppose the first two motions and filed only a comment on the third one adding that the prosecution did not raise any material argument in their comment making it unnecessary for them to file a reply. (Chito Chavez)
